Terms Of Service
Terms that govern business customer access to AfterCheck.

These are AfterCheck's first product-specific terms. They are written for product review and should be reviewed by counsel before a public launch, paid subscription rollout, or custom customer agreement.
Agreement
These Terms of Service govern access to and use of AfterCheck. By creating an account, using the service, or accessing a workspace, you agree to these Terms on behalf of yourself and, if applicable, the business or organization you represent.
AfterCheck is a business-to-business service for collecting private post-experience feedback, managing follow-up, exporting data, and preparing integrations. It is not a public review platform and does not guarantee reviews, ratings, reputation outcomes, customer responses, or business results.
Early Access And Product Changes
AfterCheck is pre-release and may be offered as early access, evaluation, local, preview, or limited commercial access. Features, limits, routes, integrations, pricing, and availability may change as the product matures. Unless a separate written agreement says otherwise, the service is provided without a service-level agreement.
Accounts And Workspaces
You are responsible for keeping account access secure and for ensuring that each user in your workspace is authorized to access the business data shown in AfterCheck. You must provide accurate account, workspace, billing, and contact information and keep it current.
A workspace owner or administrator is responsible for campaigns, feedback requests, public profile settings, next actions, API keys, webhook endpoints, exports, notification settings, and any other workspace configuration.
Customer Feedback Data
As between you and AfterCheck, you retain ownership of the customer feedback, campaign data, request data, source attribution, exports, and similar business records you submit to or generate through AfterCheck. You grant AfterCheck the rights needed to host, process, transmit, display, secure, troubleshoot, and improve the service.
You are responsible for your customer relationships, notices, permissions, and lawful basis for collecting and using customer feedback. You must not upload or request sensitive personal information through AfterCheck unless a separate written agreement allows that use.
Data Processing Addendum-Lite
AfterCheck processes personal information submitted by you, your team, and your customers to provide the service. You decide what feedback requests to send, what customer information to enter, what public links to use, what exports to download, and what integrations to configure.
You are responsible for complying with privacy, consumer protection, anti-spam, employment, industry, and other laws that apply to your business and customer communications. AfterCheck will process personal information according to these Terms, the Privacy Policy, and any separate written agreement that applies.
Customer Communications And CASL
If you use AfterCheck links, snippets, API features, email features, webhook features, or exports to contact customers, you are responsible for ensuring those communications are lawful. This includes any obligations to obtain consent, identify the sender, keep consent records, provide unsubscribe or preference mechanisms, and honour opt-out requests under Canada's Anti-Spam Legislation (CASL) and other applicable messaging rules.
AfterCheck may help generate feedback links or deliver notifications when configured, but AfterCheck does not determine whether you have permission to contact a particular person.
Review-Gating And Acceptable Use
AfterCheck is feedback-first. You must not use AfterCheck to suppress criticism, manipulate public review outcomes, route only positive feedback to public review sites, hide neutral or negative feedback paths from customers, or otherwise operate a review-gating workflow.
You also must not use AfterCheck to:
- send unlawful spam or contact people without required consent;
- upload purchased, scraped, or unauthorized contact lists;
- harass, threaten, deceive, or discriminate against customers;
- collect highly sensitive data without written approval;
- submit malware, exploit code, or unlawful content;
- probe, bypass, or interfere with authentication, rate limits, security controls, or tenant boundaries;
- resell or white-label AfterCheck without written permission;
- use the service in a way that violates applicable law.
Integrations, API Keys, Webhooks, And Exports
API keys, exports, and webhooks are data portability and integration tools. You are responsible for protecting API keys, choosing safe webhook endpoints, securing systems that receive exported data, and limiting access to people who need it.
Some integration and delivery features may be local-only, preview, gated, planned, or disabled unless the required configuration is present. AfterCheck must not be used to claim that live email, webhook, billing, or other provider delivery is active unless that provider is actually configured and enabled for your workspace.
Plans, Billing, And Payments
Billing enforcement, online checkout, payment processing, invoices, and paid subscriptions are not active in the current v0.1 product posture unless a separate written agreement says otherwise. Plan limits and paid-tier labels may be shown to explain intended future packaging.
If AfterCheck later offers paid subscriptions, fees, taxes, renewal terms, cancellation terms, refund terms, online-contract disclosures, and any order-form terms will be provided before purchase or in the applicable written agreement. Unless an order form says otherwise, fees will be non-refundable except where required by law.
Service Availability And Support
AfterCheck is provided on an "as available" and "as is" basis during early access and pre-release use. We may change, suspend, limit, or discontinue features, especially where needed for security, maintenance, provider changes, legal reasons, or product development.
Support requests can be sent to support@aftercheck.io. Support response times are not guaranteed unless a separate written agreement provides one.
Intellectual Property
AfterCheck and its software, design, workflows, documentation, brand assets, and service content are owned by AfterCheck or its licensors. These Terms do not transfer any intellectual property rights except the limited rights needed for you to use the service.
You retain rights in your business content and feedback data, subject to the processing rights described in these Terms.
Privacy And Security
The AfterCheck Privacy Policy explains how personal information is collected, used, disclosed, retained, and protected. You must use the service in a way that respects privacy, security, and customer communications laws.
You must promptly notify us if you believe an account, API key, webhook endpoint, export, or workspace has been compromised.
Suspension And Termination
We may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay amounts owed under a separate paid agreement, misuse customer data, or use AfterCheck in a way that harms the service, customers, or other users.
You may stop using AfterCheck at any time. Data export or deletion may require a support request in v0.1, subject to retention, backup, security, legal, and audit obligations.
Disclaimers
To the maximum extent permitted by law, AfterCheck disclaims all warranties that are not expressly stated in these Terms or a separate written agreement, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, or any particular business outcome.
Limitation Of Liability
To the maximum extent permitted by law, AfterCheck will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, lost data, or business interruption.
Unless a separate written agreement states a different cap, AfterCheck's total liability for claims relating to the service is limited to the greater of the amounts you paid to AfterCheck for the service in the three months before the claim or CAD $100.
Indemnity
You will defend, indemnify, and hold AfterCheck harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the service, your customer communications, your data, your breach of these Terms, or your violation of applicable law.
Governing Law And Venue
These Terms are governed by the laws of Saskatchewan and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Unless a separate written agreement says otherwise, disputes will be brought in the courts located in Saskatchewan, Canada.
Changes To These Terms
We may update these Terms as AfterCheck changes. The "Last updated" date shows when the Terms were last revised. Continued use of the service after an update means you accept the revised Terms.
